The Federal Government Just Sued Utah to Defend Your Goddamn Right to Lose Money on Sports

Utah called Kalshi's product a gambling bet. The U.S. government called it a 'swap' and filed a lawsuit so desperate it should be framed in the Hall of Shame.

The facts

The United States and the Commodity Futures Trading Commission sued the State of Utah and Derek Brown, in his official capacity as Utah Attorney General, in a complaint for declaratory and injunctive relief, Case No. 26-1055, in the United States District Court for the District of Utah, Central Division. The complaint says the Commodity Exchange Act gives the CFTC exclusive jurisdiction over commodity futures, options, and swaps traded on federally regulated exchanges, and that the United States and the CFTC brought the action to halt Utah's efforts to prohibit the operation of derivatives markets governed by federal law.

On October 20, 2026, Utah, through Attorney General Derek Brown, filed an enforcement action in the Third Judicial District Court in and for Salt Lake County against Kalshi, Inc. and KalshiEX LLC, Kalshi Klear Inc., Kalshi Klear LLC, Kalshi Trading LLC, Susquehanna International Group LLP, and Susquehanna Government Products LLLP. Utah alleged that the defendants knew sports bets and other forms of gambling bets are illegal under Utah law and chose to begin offering gambling bets to Utah residents by at least September 2024, and that Kalshi's online gambling bets are indistinguishable from the bets offered by a traditional sportsbook. Utah sought to halt the conduct, pull back illegally obtained profits, and compensate the State and its citizens.

The federal complaint answers that the event contracts targeted by Utah are swaps under the federal Commodity Exchange Act, and the exchanges offering them are CFTC-regulated Designated Contract Markets. It says Utah's efforts intrude on the exclusive federal scheme Congress designed to oversee United States commodity derivatives markets, and that the scheme expressly and impliedly preempts state gambling law as applied to event contracts. It says the United States and the Commission are injured by Utah's enforcement efforts, that the injury is irreparable and requires preliminary and permanent injunctive relief, and that Utah's action threatens to wipe out the operation of CFTC-regulated exchanges within the State. The complaint asks the court to hold that Utah gambling laws are preempted and unenforceable as applied to transactions listed, offered, or executed via CFTC-regulated markets. KalshiEX LLC, a financial services company with its principal place of business in New York, has been approved by the Commission as a Designated Contract Market.

Our take

Let's get this straight: the full fucking might of the United States government is now deployed to ensure that citizens of Utah can place a bet on the fucking Lakers game. Not to secure healthcare, not to fix the roads, but to protect the sacred, federally-regulated pipeline for some dickhead in Salt Lake City to lose his mortgage payment on a parlay. The CFTC looked at a digital sportsbook, slapped a ‘Designated Contract Market’ sticker on its ass, and now expects us to salute while they sue a state for having the gall to enforce its own laws. It’s the most pathetic, transparent grift in the history of finance, and the feds are the bag-men.

Utah Attorney General Derek Brown, a joyless prick in his own right, at least has the balls to call a spade a spade. He said Kalshi’s product is ‘indistinguishable from the bets offered by a traditional sportsbook.’ He’s right. It’s gambling. But the federal complaint reads like a hostage note written by a hedge fund manager. Utah’s enforcement action is an ‘irreparable injury’ to the United States? It ‘threatens to wipe out the operation of CFTC-regulated exchanges’? Oh, fuck off. The only thing being wiped out is the last shred of dignity in a regulatory agency that now exists to provide legal cover for gambling apps.

The core argument is so ass-backwards it’s a miracle the Justice Department lawyer didn’t choke on his own tongue. They’re claiming that because Congress gave the CFTC ‘exclusive jurisdiction’ over ‘swaps,’ that means a state can’t stop its residents from betting on sports if the betting platform files the right paperwork. It’s like claiming the FDA has exclusive jurisdiction over cocaine if you call it a ‘dietary supplement’ and sell it on a regulated exchange. The preemption doctrine isn’t a magic wand you wave to turn a casino into a pillar of the national economy.

So here we are. The United States of America is in federal court, begging a judge to stop Utah from protecting its citizens from what Utah calls gambling, because the federal government has decided its most vital interest is the uninterrupted flow of sports wagers. It’s a spectacular, shameful farce. The CFTC has become a croupier with a gavel, and the only thing they’re regulating is their own descent into becoming absolute fucking clowns.
