Voting Rights Clowns Sue Over Sealed Envelopes After the Election Already Fucking Started

Federal judge denies last-minute emergency motion, noting plaintiffs knew the rules for months and then sued like a bunch of distracted fuckwits.

The facts

On October 19, 2026, U.S. District Judge Thomas D. Schroeder denied a motion for preliminary injunction brought by the North Carolina Alliance for Retired Americans, North Carolina Asian Americans Together, Down Home North Carolina, and two individual voters. The groups were challenging guidance from the North Carolina State Board of Elections, the 2026 Numbered Memo issued September 4, which set rules for verifying signatures on absentee ballots and for rejecting ballots whose inner envelopes were not sealed. The suit also named the Guilford County and Durham County boards of elections. The court held an expedited hearing on October 14, 2026.

The judge's order dwells at length on the plaintiffs' timing. The State Board argued the groups had known since at least February 2026 that these rules were coming, yet waited eighteen days after the September 4 memo to file suit, and then waited until one day before the first county board meetings to consider absentee ballots to move for a preliminary injunction. In the court's words: "Plaintiffs have also delayed. They waited eighteen days after the 2026 Numbered Memo was issued to bring this action, and they did not file their motion for preliminary injunction until the day before the counting of absentee ballots would begin."

Schroeder also found the election was too far along to rewrite the rules, writing: "[t]he election is not merely upcoming; it has already started." Absentee voting had already begun, he noted, and early voting was underway. On the merits, the court held the challengers had not made the "clear showing" the law requires, finding neither challenged provision burdensome: the rules require the voter to sign his or her own name and place the ballot in a sealed envelope, and the memo provides notice and cure, with voters promptly notified of deficiencies and given another ballot or the option to vote early or on Election Day.

Our take

Let’s get this straight: a pack of professional democracy-savers, the kind that shriek about fascism in your inbox every other Tuesday, managed to fuck up a lawsuit so badly a judge had to tell them the election they were trying to stop had already begun. They knew the rules were coming in February. The memo landed September 4th. These geniuses waited eighteen days to file suit. Then, in a move of breathtaking legal cowardice, they waited to ask for an emergency injunction until the day before counties started counting fucking ballots. You could not design a more pathetic display of performative incompetence if you tried. These groups aren't protecting voting rights; they're cosplaying as lawyers while the actual election passes them by like a bus they missed because they were too busy drafting a press release. The judge’s order basically reads as a public service announcement: the ballots are in the mail, you useless pricks. The entire case was built on the premise that this was an emergency requiring immediate court intervention, but their own timeline suggests they treated it with the urgency of a man deciding what to watch on Netflix. They want to be seen as the cavalry, but they showed up after the battle was over and started complaining about the fucking horse feed. It’s the legal equivalent of calling the fire department because your toast is burnt - after you’ve already eaten the toast and washed the plate. The sheer, unadulterated gall of asking a federal court to rewrite the rules of an ongoing election because your own lawyers couldn’t be bothered to file paperwork before the starter pistol fired is the kind of arrogant bullshit that makes people hate activists. They didn't just lose; they got laughed out of the courtroom for being the bureaucratic equivalent of a soggy, unsealed envelope - utterly fucking useless. Next time, maybe try giving a shit before the clock runs out, you absolute clowns.
