Supreme Court Considers Whether Oil Companies Are Legally Obligated to Pay for the Catastrophe They Fucking Engineered

Exxon and Suncor claim climate change is a global 'everyone's fault' issue, not their profitable lie, as a Colorado county tries to make them cover the costs of the fires their deception helped fuel.

The facts

On the first day of its new term, the Supreme Court heard arguments in a case brought by Boulder County, Colorado, against Suncor Energy and ExxonMobil. The lawsuit, filed in 2018, alleges the companies deceived the public about their role in climate change and seeks damages to cover the costs of disasters linked to it. Tawnya Somauroo, a resident whose home was destroyed in the 2021 Marshall Fire, expressed frustration that residents are left to bear the costs of rebuilding and securing their neighborhoods against climate-related threats. The companies argue that climate change is a global issue caused by everyone and that such lawsuits are not the appropriate venue for addressing it. They contend that the federal government, through the Clean Air Act, is responsible for regulating emissions. The Trump administration supported this view, stating that these lawsuits represent an unconstitutional power grab by states attempting to regulate beyond their borders. However, Boulder County maintains it is only seeking compensation for local costs. The case comes before a conservative-majority court, and Justice Samuel Alito has recused himself, creating the possibility of a tie vote.

Our take

Let’s get this straight: the most powerful court in America, currently staffed by justices who likely think 'carbon offset' is a rugby play, is solemnly debating whether corporations that knowingly torched the planet for profit can be held financially responsible. What a magnificent, stinking farce. The case hinges on Boulder County’s simple, fucking reasonable request: you lied about your product causing climate chaos, our shit burned down, now pay to help fix it. The oil giants’ defense is a work of sociopathic genius. They stand before the justices and argue, with presumably straight faces, that climate change is a 'global issue caused by everyone.' This is the legal strategy of a kid who smashes a window and then blames the entire neighborhood for living in houses made of glass. You spent 50 years and billions of dollars on propaganda to confuse the public, bought politicians to kneecap regulations, and banked record profits from the very substance cooking the atmosphere. But when the flames literally arrive at the doorstep of the people you defrauded, your answer is to shrug and say 'we all share the air, buddy.' You absolute, planet-sizzling cunts.

The gall is breathtaking. These dickheads now want to hide behind the Clean Air Act, a law they’ve spent decades trying to gut, claiming that only the federal government can deal with emissions. It’s like a mob boss arguing only the FBI can arrest him after he’s spent a lifetime bribing the local police. The Trump administration, a collection of oil-industry fluffers who thought rising sea levels were a liberal plot, naturally chimed in to call the lawsuit an 'unconstitutional power grab.' Of course they did. Their idea of environmental policy was letting coal executives wipe their asses with the Endangered Species Act. The county isn’t trying to regulate global emissions, you dishonest pricks; it’s trying to make you cover the local costs of the disasters your deception accelerated. It’s the difference between suing a cigarette company for your lung cancer and trying to ban smoking worldwide.

And the fucking cherry on this shit-sundae is the court itself. Justice Samuel Alito, a man whose portfolio probably includes a nice chunk of Exxon stock, had to recuse himself. So this landmark decision on corporate accountability for planetary arson could end in a tie, decided by one less fossil on the bench. It’s a perfect metaphor: the system is so corrupted by the interests it’s supposed to judge that it can’t even muster a full panel to hear the case. Meanwhile, Tawnya Somauroo and thousands of others are left holding the bag, paying to rebuild homes incinerated by a crisis these companies manufactured and then lied about. The oil lawyers will bill millions to argue that responsibility is a quaint local concept, while the bill for the apocalypse gets forwarded to the taxpayers. It’s not just bullshit; it’s a fully orchestrated symphony of greed, cowardice, and legalistic piss-taking, performed for an audience of burning ruins.
