The facts
On September 29, 2026, a federal judge in Connecticut granted a preliminary injunction against the Federal Bureau of Prisons and ordered it to "immediately reinstate the CBA" with the National Council of Prison Locals, the AFGE council known as CPL-33, for the remainder of the agreed-upon term. The court had found the BOP director's termination letter and public message contradictory, writing that an agency "cannot offer an entirely pretextual explanation that is undermined by its own contradictory assertions made the same day."
The original kill shot came September 25, 2025, when the BOP told the union that under President Trump's Executive Order 14,251, it "no longer recognizes [CPL-33] as the exclusive representative for employees of the existing bargaining unit." The union sued that November. A year later, the court ordered the contract restored.
The Bureau's compliance lasted eight days. On October 2, the government filed a notice of compliance saying it was obeying the order, while adding that it did not understand the injunction to preclude 'a fresh decision to terminate the CBA' before the end of the agreed-upon term. On October 7, Director William K. Marshall III issued exactly that: a fresh decision re-terminating the agreement. On October 8, DOJ lawyers filed the opposition brief this draft is built on, insisting the Bureau is compliant with the court's order and that the union's contempt motion should be denied.
Our take
This is the most flagrant, shit-eating bit of bureaucratic trolling ever filed in a federal court. The judge caught the BOP using a bullshit excuse to fuck over its union, called it 'entirely pretextual', and ordered them to cut the shit. So what does Director William 'Fresh Start' Marshall III do? He waits a whole eight fucking days - basically a long weekend plus time for the ink to dry on the court order - and then issues the same goddamn termination, but this time with a new cover sheet that says 'fresh decision'. This isn't a legal strategy; it's the administrative equivalent of a kid who got caught stealing cookies putting them back, waiting for mom to leave the kitchen, and then shoving the whole jar down his pants. The absolute gall of this prick is breathtaking. He's treating a federal injunction like a fucking Netflix subscription he can cancel and re-subscribe to whenever he gets a promotional email. The Justice Department's lawyers then had to stand up in court, or at least file a brief, with a straight face and argue that yes, Your Honor, we are in full compliance because we freshly decided to ignore you. It’s a contempt of court motion wrapped in a 'fuck you' and delivered by a government-paid courier. Marshall and his cadre of federal dickheads are betting the judge is too busy, or too tired of their shit, to call this what it is: a deliberate, middle-finger violation of a direct order. If this 'fresh decision' defense works, then every two-bit agency head in Washington now has a playbook: lose in court, pretend to comply for a week, then do the exact same illegal thing but say 'please' this time. It reduces the entire federal judiciary to a nagging parent whose orders can be circumvented with a thesaurus and a new date stamp. William K. Marshall III isn't running the prison system; he's performing a clown show in a suit, and the union guards he's fucking over are the ones who have to clean up the peanut shells and elephant shit. The only thing that should be fresh is the contempt citation slapped on his smug, compliant face. Fucking unbelievable. Cunts.
